ELIGIBILITY: This Contest is open to individuals aged 18 or older who ‘like’ the Palms Trading Company Facebook page (https://www.facebook.com/PalmsTradingCompany), submit their name, e-mail and Contest entry essay, and are a legal resident of the fifty United States and District of Columbia. Employees, suppliers, officers and directors of Sponsor, its parent companies, affiliates, subsidiaries, advertising, promotion, fulfillment agencies, legal advisors, the immediate family members, and persons living in the same household of such persons are not eligible. Additional restrictions may apply. If an individual meets the above requirements and submits an entry to participate in the Contest, they will be considered a participant (“participant”) in the Contest.
ENTRY: To enter, access the Contest entry application from /your-mother-deserves-the-best-mothers-day-contest-entry-form/ during the Contest period, ‘like’ the fan page and follow the online instructions to complete and transmit the entry information and essay that includes both full name, email address, phone number and entry essay. Entries must be received by 5 p.m. (MST) on April 18, 2014 and tracked by Palms Trading Company. Limit one entry per person/email address. You may enter the promotion under one name and one name only. Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. An eligible individual receives 1 (one) entry for the Contest when the individual submits the requested information. Participant will not be notified if disqualified. All entries become the property of Sponsor. Participants in the Contest will not be notified if their entry was not submitted properly.
PRIZE: 1 (one) winner will be selected to win 1 (one) Prize. The prize is 1 (one) bracelet, necklace and earring set. The specifics of the prize shall be solely determined by the Sponsor. No cash or other prize substitution permitted except at Sponsor’s discretion. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. Winners must contact Sponsor within 10 (ten) business day of receiving notification of award to redeem their prize. Palms Trading Company reserves the right to substitute the listed prize for prizes of equal or greater value.
SELECTION OF WINNER: 1 (one) winner will be selected by majority vote beginning on April 21, 2014 and ending on May 1, 2014. The odds of winning depend on the number of eligible entries received. The winner will be notified 1 (one) time via the e-mail address and/or phone number provided in their entry form. Sponsor is not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to notify potential winner. The potential winner may be required to sign and return an affidavit of eligibility, release of liability, and where lawful, a publicity consent and release agreement, all within 10 (ten) business days of notification or attempted notification. By accepting and/or using prize, winner consents to the use of his/her name, voice and/or likeness for the purpose of advertising, trade, or promotion without further compensation, unless prohibited by law and upon request will provide such consent in writing. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 10 (ten) business day from the time award notification was sent, or fails to timely return a completed and executed declaration and releases as required, prize may be forfeited and an alternate winner may be selected. The receipt by winner of the prize offered in the Contest is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS A WINNER OF THE CONTEST AND ALL PRIVILEGES AS A WINNER WILL BE IMMEDIATELY TERMINATED.
GENERAL TERMS AND CONDITIONS: By entering, each participant agrees (a) to be bound by these Official Rules and the decisions of Sponsor, which shall be final, and (b) that Sponsor, agents and representatives of Sponsor, its parent companies, affiliates, subsidiaries, officers, directors, employees, legal advisors and advertising, promotion, fulfillment agencies are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, unintelligible, postage-due entries, mail, or e-mail; (ii) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties of any kind; (iii) failed, incomplete, garbled, or delayed computer transmissions; (iv) any condition caused by events beyond the control of the Sponsor that may cause the Contest to be disrupted, corrupted, delayed or terminated; (v) any injuries, losses, or damages of any kind arising in connection with or as a result of the prize, or acceptance, possession, or use of the prize, or from participation in the Contest including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy; or (vi) any printing or typographical errors in any materials associated with the Contest. Sponsor reserves the right, in its sole discretion, to modify, suspend, or cancel the Contest at any time if the Contest is not capable of running as planned, including if a computer virus, bug, or other technical problem corrupts the administration, security, or proper play of the Contest. Sponsor reserves the right at its sole discretion to disqualify any individual or entity it finds to be attempting to defraud or in any way tamper with the Contest. This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook. By entering this Contest, you agree to a complete release of Facebook. You understand that you are providing your information to Palms Trading Company and not to Facebook. The information you provide, including name and contact information, will not be sold or distributed in any manner and will be used solely by Palms Trading Company, at the discretion of Palms Trading Company. Palms Trading Company reserves the right to use all participants’ writing or images including, but not limited to, Facebook profile images. Palms Trading Company reserves the right to post said writing or images on the Palms Trading Company website, Palms Trading Company blogs, Palms Trading Company Facebook page, Palms Trading Company Twitter account, as well as any other media platform representing Palms Trading Company.
DISPUTES: THE CONTEST IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE STATE OF NEW MEXICO, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in the Contest, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected to the Contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Illinois having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than participants’ actual out-of-pocket expenses (i.e., costs associated with entering the Contest or redeeming the gift certificate), and participant further waives all rights to have damages multiplied or increased.
OFFICIAL RULES: The Contest can ONLY be entered via the third party application on the Facebook Platform. Entries submitted Palms Trading Company via any other method, communication, or post will be disqualified. The entrant will not be notified of disqualification.
